Photosensitive seizure warning
A very small percentage of people may experience a seizure or other adverse symptoms when exposed to certain visual images, including flashing lights, high-contrast or moving patterns, or rapidly changing colors that can appear in software. These symptoms can occur even in people who have no history of seizures, epilepsy, or any other condition.
If you, or anyone in your family, has an epileptic condition or has ever experienced seizures of any kind, consult a physician before using this App.
Stop immediately if you feel unwell
Immediately stop using the App and consult a physician if you or anyone using the App experiences any of the following symptoms:
- dizziness, lightheadedness, or fainting
- altered, blurred, or otherwise disturbed vision
- migraine, severe headache, or eye strain
- loss of awareness, confusion, or disorientation
- any involuntary movement, muscle twitching, or convulsion
- nausea
Reduce your risk
To reduce the likelihood of discomfort or a photosensitive reaction while using the App's animated visualizers:
- Use the App in a well-lit room and avoid using it when you are drowsy or fatigued.
- Sit a comfortable distance from the screen and keep screen brightness moderate.
- Take a 10–15 minute break for every hour of use.
- Stop immediately if you begin to feel unwell.
Controls available to you
The visualizers are an optional, decorative feature. You remain in control of them at all times:
- Turn visuals off: Select the "Lights Out" visualizer to disable all on-screen animation while you continue listening.
- Reduce motion: When your device's system "Reduce Motion" accessibility setting is enabled, the App automatically freezes the generative visualizers to a single still image: they do not animate, move, or flash.
The App is designed to avoid full-screen content that flashes more than three times per second, consistent with the general-flash guidance of the Web Content Accessibility Guidelines (WCAG 2.3.1). No software can guarantee that its visuals are safe for every individual, and this warning does not substitute for professional medical advice.
Acknowledgement and assumption of risk
This warning is provided for your safety. By using the App, you acknowledge that you have read and understood this warning, that you use the App and its visual features entirely at your own risk, and that you assume all risk of any photosensitive or other adverse reaction. To the maximum extent permitted by applicable law, Optophone and its developer disclaim all liability for any injury, harm, loss, or adverse effect arising from or relating to your use of the App, including its animated visual features. Nothing in this warning excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, this warning does not affect your statutory rights. This warning supplements, and does not limit, the "Disclaimer of Warranties" and "Limitation of Liability" sections of our Terms of Service.
